These Terms of Service ("Terms") are a binding agreement between you and eVamb Technologies ("eVamb", "we", "us"). By accessing or using evamb.com (the "Site"), you agree to these Terms. If you do not agree, please do not use the Site.
1. Who we are
eVamb Technologies is an applied-AI lab based in Toronto, Canada. The Site presents information about eVamb, eVamb Labs, neekOS, and the Connext family of products. Use of any specific product or service may be governed by a separate written agreement, which prevails over these Terms to the extent of any conflict for that product.
2. Use of the Site
You may use the Site for lawful, personal, and business-evaluation purposes. You agree not to:
- use the Site in violation of any applicable law or regulation;
- attempt to gain unauthorised access to, interfere with, or disrupt the Site or its infrastructure;
- scrape, harvest, or systematically extract data except as permitted by our robots directives;
- misrepresent your identity or affiliation, or use the Site to transmit unlawful or harmful content.
3. Intellectual property
The Site and its content — including text, design, graphics, the eVamb wordmark and V-node, logos, and the names "eVamb Technologies", "eVamb Labs", "neekOS", and "Connext" — are owned by eVamb or its licensors and are protected by intellectual-property laws. You may not copy, reproduce, or create derivative works from the Site without our prior written consent, except for ordinary browser caching and personal, non-commercial reference.
4. Product stage and forward-looking statements
We label the development stage of our products honestly (for example: in dev, in trial, in pilot, beta, live). Descriptions of products that are not yet generally available are provided for information only, are subject to change, and do not constitute a commitment to deliver any feature, functionality, or timeline.
5. Third-party links
The Site links to other properties we operate (such as evamb.io and neekos.ai) and to third-party sites. We are not responsible for the content or practices of third-party sites, and links do not imply endorsement.
6. Disclaimers
The Site is provided "as is" and "as available" without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Site will be uninterrupted, error-free, or free of harmful components. Nothing on the Site constitutes professional, legal, financial, or medical advice.
7. Limitation of liability
To the maximum extent permitted by law, eVamb and its officers, employees, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, or data, arising out of or related to your use of the Site. Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law, including under Ontario's Consumer Protection Act, 2002 and Quebec's Consumer Protection Act where they apply.
8. Indemnity
You agree to indemnify and hold eVamb harmless from any claims, losses, and expenses arising from your misuse of the Site or breach of these Terms.
9. Privacy
Our handling of personal information is described in our Privacy Policy and Cookie Policy, which form part of these Terms.
10. Changes and termination
We may modify the Site or these Terms at any time; material changes take effect when posted here with an updated date. We may suspend or restrict access to the Site at our discretion, for example to protect its security or integrity.
11. Governing law
These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable there, without regard to conflict-of-laws rules. The courts located in Toronto, Ontario have exclusive jurisdiction, subject to any mandatory consumer-protection rights you have in your place of residence.
